TimelessTune (operated by Abstractika OÜ) provides personalized song creation services where professional composers create custom songs based on your personal stories, memories, and preferences.

3. Order Process & Payment

• 🛒 Order Placement: Complete the order form with your song requirements and personal stories
• 💳 Payment: Full payment required before song creation begins. We accept major credit cards and PayPal
• 📧 Confirmation: Order confirmation and project timeline sent via email
• ⏱️ Production Timeline: Standard delivery within 24 hours from order confirmation

4. Intellectual Property Rights

• ✅ Your Rights: Full ownership of the final song for personal use, sharing, and gifting
• 📝 Personal Stories: You retain ownership of your personal stories and memories shared with us
• 🎵 Musical Elements: We retain rights to generic musical elements, chord progressions, and production techniques used across multiple projects
• 📊 Portfolio Usage: We may request permission to use anonymized excerpts for our portfolio (optional)

5. Customer Responsibilities

To ensure the best possible custom song, you agree to:

• 📋 Accurate Information: Provide truthful, complete information about your stories and preferences
• ⏰ Timely Responses: Respond to composer questions and revision requests promptly
• 🎯 Clear Feedback: Provide specific, constructive feedback during the revision process
• 🔒 Appropriate Content: Ensure your stories and requests comply with our content guidelines
• 📞 Availability: Maintain reasonable availability for project communication

6. Revision Process

• 1️⃣ First Draft: Receive initial song version for review and feedback
• 💬 Feedback Window: 7 days to provide revision requests after receiving draft
• 🔄 Two Rounds Included: Price includes up to two rounds of reasonable revisions
• ⚡ Revision Scope: Revisions cover lyrical changes, musical adjustments, and production tweaks
• 💰 Additional Revisions: Major changes beyond two rounds may incur additional fees

7. Delivery & Acceptance

• 📧 Digital Delivery: Final songs delivered via secure download link to your email
• 💾 File Formats: High-quality MP3 and WAV files included with each order
• ⏳ Download Period: Download links active for 90 days from delivery
• ✅ Acceptance: Song considered accepted if no revisions requested within 7 days of final delivery
• 🔒 Backup Storage: We maintain secure backups of all final songs for 3 years

8. Refund Policy

• 🔄 Full Refund: Available if cancellation occurs before composer assignment
• 💰 Partial Refund: 50% refund if cancellation after composer assignment but before first draft
• 🎵 No Refund: After first draft delivery, as significant creative work has been completed
• ⚠️ Quality Issues: If unsatisfied with final product, we work to make it right before considering refunds

9. Content Guidelines

To maintain a positive creative environment, we reserve the right to decline projects containing:

• 🚫 Hate speech, discrimination, or offensive content
• 🚫 Explicit sexual content or inappropriate themes
• 🚫 Defamatory, libelous, or false information
• 🚫 Content promoting illegal activities or violence
• 🚫 Copyrighted material you don't have permission to use

If we decline your project due to content guidelines, you'll receive a full refund.

10. Privacy & Confidentiality

• 🔒 Story Confidentiality: Your personal stories and memories are treated as strictly confidential
• 👥 Limited Access: Only essential team members involved in your project access your information
• 📊 Data Usage: We use your information solely for song creation and service delivery
• 🌐 International Processing: Your data may be processed by our global team of composers with appropriate safeguards

11. Limitation of Liability

To the extent permitted by Estonian law, Abstractika OÜ's total liability for any claim related to our services shall not exceed the amount you paid for your song order.

• ⚖️ No Consequential Damages: We're not liable for indirect, special, or consequential damages
• 🎵 Creative Interpretation: We're not liable for subjective interpretation of your stories
• 💝 Emotional Response: We're not liable for the emotional impact of the song on recipients
• 📅 Delivery Delays: We're not liable for delays caused by circumstances beyond our control

12. User Conduct & Prohibited Uses

You agree not to use our service for:

• 🚫 Commercial resale of our custom songs without additional licensing
• 🚫 Impersonation or fraudulent requests
• 🚫 Harassment of our team members or composers
• 🚫 Reverse engineering or copying our service methodology
• 🚫 Any illegal activities or violations of third-party rights

13. Termination

We may suspend or terminate your access to our services if you violate these terms. You may terminate your account at any time by contacting us.

• ⚠️ Violation of Terms: Immediate termination for serious breaches
• 💬 Notice: We'll provide notice and opportunity to cure minor violations when appropriate
• 📦 Active Orders: Termination doesn't affect rights and obligations for active orders

14. Dispute Resolution

• ⚖️ Governing Law: Estonian law governs these terms and any disputes

These terms, together with our Privacy Policy, Refund Policy, and any order-specific agreements, constitute the entire agreement between you and Abstractika OÜ (trading as TimelessTune) regarding our services and supersede all prior agreements and understandings.
